Contract Data Promotion Terms and Conditions

• All prices shown include VAT.
• Promotional contracts:
  • are available from 14 May 2012 to 31 July 2012. To this end, Cell C reserves the right to withdraw this promotion on notice to you.
  • will have a contract term of 24 months.
  • are available to new customers.
  • are available to existing Cell C customers as a renewal / upgrade or as an additional service line.
  • are available via all participating Service Providers.
• No migrations to the promotion contracts is allowed.
• Once-off SIM + Connection fees apply.
• Customers can choose between a "SIM + DATA" only offer or a "SIM + DATA + Device offer".
• The Contract SmartData Offer is available for a monthly fee as per table 1, which shall include:
  • a Cell C data enabled SIM card.
  • data, which shall be equally allocated every month for 24 months.
  • other than the first month when the data allocation and monthly subscription will be pro-rated according to the number of days remaining in the month; and
  • A device as per advertised deal – if this option is selected by the customer.

• The SIM shall be provisioned to access Cell C's HSPA+ network (where coverage is available).
• The included DATA does not apply to international roaming usage.
• None of the tariffs in the table apply to international roaming usage.
• Customers are charged or data is depleted on a usage basis (i.e. for data volume uploaded and downloaded) and NOT for the time connected.
• You will receive your first pro-rated data bundle as soon as RICA is completed and the line is activated.
• The initial data bundle will be valid until the end of that calendar month.
• New data bundles will be loaded on the first of every month at 00:00:00.
• Bundles will expire at the end of every calendar month at 23:59:59.
• Data may not and cannot be transferred from one user to another or converted into Rand value.
• Upon expiration there shall be no rollover of unused data to the following month.
• Once the 24 months have passed:
  • The contracts will continue on a month-to-month basis.
  • The monthly subscription will then revert to the subscription fee for the relevant 24 month package which is in the market at the time.
  • Customers can renew/upgrade to the postpaid data package of their choice.
• Once the included bundle has been depleted, additional data usage will be debited to your bill.
• You can purchase data bundles to add to your account.
• Standard data bundle rules apply which can be found at www.cellc.co.za/data-contract-packages.
• The SIM card obtained when purchasing this data bundle offer may be used for non-data usage if such SIM is inserted into a handset. Non-data usage shall include SMS, voice calls and MMS.
• Non-data usage (voice, SMS and MMS) shall be billed as per the contract tariff plan.
• Cell C reserves the right at any time to vary these terms and conditions or to withdraw the Smartdata Contract offer should it be required to do as a result of and law or any changes to the law. In such event, it is important that all subscribers who have activated the Smartdata Contract offer understand that they waive any rights that they may have against Cell C and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against Cell C, their directors, affiliates, members, partners, employees, sponsors, agents or consultants.

Prepaid Data Offer (Sim only) Terms and Conditions

• All prices shown include VAT.
• The SmartData 24GB is available on promotion from 14 May 2012 to 31 July 2012 for a once-off fee of R1299.
• The SmartData SIM Offer is available for a once-off fee, which shall include:
  • a Cell C data enabled SIM card and
  • the applicable data amount.
• The Cell C Easy Chat All Day prepaid tariff plan and business rules apply. These can be found at www.cellc.co.za or at a Cell C store.

• The 3GB SmartData SIM has a 365 day validity period from the date of activation while the other SIMS has a 360 day validity period.
• All data usage, from the time of activation until expiry or depletion (whichever comes first) will be deducted first from the balance of the preloaded data bundle.
• For the 3GB SIM:
  • the data is loaded after successful activation of the SIM and is valid for 365 days from this activation date.
• For the other Data SIMs:
  • the initial / first bundle of 1GB/2GB/5GB is loaded after successful activation of the SIM and is valid for 30 days.
  • The included bundles expire at 23h59:59 on the 30th day.
  • The 11 subsequent bundles are loaded at 00h00:00 on the 1st day of the next cycle.
• Data may not and cannot be transferred from one user to another or converted into Rand value.
• Upon expiration there shall be no rollover of unused data to the following month (12GB/24GB/60GB) or year (3GB).
• Should the customer deplete his/her data allocation before the end of the 365 day validity period for the 3GB SIM or before the end of the month for any of the other offers, he/she can recharge with a Cell C Recharge or SmartData voucher and purchase a Cell C data bundle. Once the data has been loaded, the in-bundle rate for that data voucher or data bundle will apply.
• The SIM card obtained when purchasing this data bundle offer may be used for non-data usage if such SIM is inserted into a handset. Non-data usage shall include SMS, voice calls and MMS.
• Non-data usage (voice, SMS and MMS) shall be billed as per the Easy Chat All Day tariff plan.
• Cell C reserves the right at any time to vary these terms and conditions or to withdraw the SmartData SIM should it be required to do as a result of and law or any changes to the law. In such event, it is important that all subscribers who have activated the Smartdata SIM understand that they waive any rights that they may have against Cell C and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against Cell C, their directors, affiliates, members, partners, employees, sponsors, agents or consultants.

Prepaid Data Offer (Sim and device) Terms and Conditions

• The SmartData 24GB is available on promotion from 14 May 2012 to 31 July 2012 for a once-off fee of R1999.
• The SmartData 3GB is available on promotion from 01 March 2012 to 30 June 2012 for a once-off fee of R599.
• The Prepaid SmartData Offer is available for a once-off fee, which shall include:
  • a Cell C data enabled SIM card;
  • data, which shall be valid for 365 days for 3GB/360 days for the others.
  • a Cell C Speed Stick capable of a maximum theoretic download speed of up to 7.2 Mbps or 21.6Mbps or a wifi router as advertised OR as per advertised deal.

• The SIM card obtained when purchasing this data bundle offer may be used for non-data usage if such SIM is inserted into a handset. Non-data usage shall include SMS, voice calls and MMS.
• Non-data usage (voice, SMS and MMS) shall be billed as per the Easy Chat All Day tariff plan.
